Privacy policy

How we collect, use and protect your personal information, and the rights you have under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Vyde is an advertising creative platform used by Advertisers to build and deliver interactive ads on websites. Our goal is to create non-intrusive advertising experiences that delight consumers and help them learn more about a brand's product/service in a fun, interactive way.

We understand that privacy and the security of your personal information is very important, and therefore we take this seriously.

This Privacy Policy sets out how we collect and use information about you, and explains your rights under the UK GDPR, how to raise a complaint with us, and how to contact us.

End user of our product

If you are an end user (i.e. if you interact with an Ad that an Advertiser has created on our platform and served on a website you're on), we only collect minimal data in order to deliver the experience to you and anonymously measure the effectiveness of the Ad for the Advertiser.

We do not use or store cookie data, and we cannot track you across any other website after you stop interacting with the Ad. The only personal data collected is the IP address and user agent string. We collect these to help detect ad fraud and prevent malicious attacks.

Processing of the IP address and user agent string is carried out in accordance with Article 6(1)(f) of the UK GDPR, on the basis of our legitimate interest in platform security and in measuring the delivery of advertising we serve. We use this data for two purposes: to help detect ad fraud and prevent malicious attacks (for example, identifying patterns of abnormal activity from a particular IP address over time), and to generate coarse, non-identifying location data (for example, at country or region level) for a given ad impression.

We retain the full IP address for up to 90 days, which allows us to detect fraudulent patterns that only become apparent over that period (see "How long do we keep your personal information for?", below, for more detail). After 90 days, the IP address is anonymised; from that point on, only the anonymised, coarse location output is used or retained. The full IP address is not passed on to third parties and is not used for anything beyond these two purposes. We reserve the right to check server log files subsequently if there are concrete indications of illegal use.

We also use Sentry, a bug/error tracking service that helps us keep track of problems as they occur when an Ad is served to you. Sentry doesn't collect personal data as such. It collects:

  • the error message,
  • the cause of the error and relevant references to our own code, and
  • the user-agent string (information about the browser and operating system you're using).

Sentry does briefly receive your IP address in transit, but this isn't visible to us, isn't used by us, and is deleted on arrival by Sentry.

We do not carry out any solely automated decision-making, including profiling, that produces legal or similarly significant effects on end users.

Vyde is an approved vendor on The Transparency and Consent Framework 2.0 (TCF), operating a Consent Management Platform with identification number 1014, and is a member of the IAB UK. We strive to meet the highest standards to deliver the best experiences to you as the end user of our product.

How do we collect information about you?

Where you have a business relationship with Vyde (as a client), we collect your data so that we can provide our services to you.

We collect information about you by telephone, email, or if we meet with you personally. Following our conversation, data relevant to your account and the services we provide is entered into our system so we can create your account and manage your data for the following purposes:

  • Contract negotiation
  • Invoicing
  • Providing support for the use of our products
  • Reporting

We use Pipedrive to hold and manage this information. Pipedrive is a Customer Relationship Management platform that lets us customise your account so we can provide a better service to you.

Some of the personal data we collect from clients is required to perform our contract with you, for example contact and billing details needed to invoice you or provide support. Where this is the case, we'll be clear about which specific data is required and what happens if it isn't provided.

What information do we collect?

We collect:

  • Title, first and last names
  • Job title
  • Company name
  • Email address
  • Telephone number
  • Postal address
  • Date and time of our contact, and when you last used our services
  • The pages you visited on our website and how long you spent on them
  • Your IP address
  • The internet browser and device you're accessing our website from
  • Cookies (see "About our use of cookies," below)

How is your personal information used, and on what legal basis?

Use of personal information under UK data protection law must be justified under one of a number of legal grounds. The grounds we rely on are:

  • Performance of a contract: the legal basis for processing your data as a client of Vyde, where we need your data to provide our agreed services to you.
  • Legitimate interests: we may also process personal data in order to send you information about our products and services, based on our legitimate interest as a business in maintaining that relationship. We use Mailchimp to manage our mailing list. If you no longer want to receive this information from us, contact us at privacy@wearevyde.com and we'll remove you from our mailing list.

We do not carry out any solely automated decision-making, including profiling, that produces legal or similarly significant effects on our clients.

How do we keep your personal information safe?

We use technical and organisational security measures, including encryption, to protect your personal information against manipulation, loss, destruction and unauthorised access by third parties. We host our platform and store data using Amazon Web Services (AWS).

All personal information we collect is stored securely.

How long do we keep your personal information for?

End users

We retain the full IP address collected from end users for up to 90 days, which allows us to detect fraudulent patterns that only become apparent over that period. After 90 days, the IP address is anonymised; from that point on, only the anonymised, coarse location output is used or retained, and the full IP address is deleted.

Customers of Vyde

Client data is retained for at least the duration of our contract with you, and for a limited period afterwards where we have a legal or legitimate business reason to do so (for example, tax and accounting requirements, or to defend legal claims).

Your rights

Under data protection law, you have the following rights in relation to your personal information:

  • The right to rectification: to have inaccurate personal data corrected, or incomplete data completed.
  • The right to erasure ("the right to be forgotten"): to ask us to delete your personal data, in certain circumstances.
  • The right to restrict processing: to ask us to limit how we use your data, in certain circumstances.
  • The right to data portability: to obtain and reuse the personal data you've provided to us, for your own purposes, across different services.
  • The right of access: to ask us for a copy of the personal data we hold about you (a "subject access request").

You can exercise any of the above rights verbally or in writing, at any time, by contacting privacy@wearevyde.com. We may need to verify your identity first, and we'll respond within one month.

Your right to object

You have the right to object to our processing of your personal data. This is an absolute right where we process your data for direct marketing purposes: if you object to marketing, we will always stop. In other circumstances, this right applies where relevant to our specific grounds for processing.

Where a statutory or contractual obligation requires you to provide certain personal data to us (for example, billing details needed to invoice you under our contract), we'll make clear at the time which data this applies to and what happens if it isn't provided.

How to complain

Complaining to us directly. If you're unhappy with how we've handled your personal data, please contact us first at privacy@wearevyde.com, or write to us at Vyde Limited, Floor 13, Unity Building, 20 Chapel Street, Liverpool, L3 9AG. A designated point of contact handles all data protection queries and complaints on our behalf.

When you raise a complaint with us, we will:

  • acknowledge it within 30 days of receipt;
  • without undue delay, take appropriate steps to investigate it and keep you informed of progress; and
  • tell you the outcome once we've concluded our investigation.

Legitimate interest (TCF)

Vyde Limited participates in the IAB Europe Transparency & Consent Framework and complies with its Specifications and Policies. Vyde Limited operates a Consent Management Platform with identification number 1014.

Under the TCF, we collect anonymous data in the following categories on the basis of legitimate interest:

  • Measure advertising performance
  • Measure content performance
  • Develop and improve services
  • Ensure security, prevent and detect fraud, and fix errors
  • Deliver and present advertising and content

This anonymous data is used to analyse and evaluate user behaviour to enhance and optimise our services, ensuring a better experience for all our users. Security is a key purpose of our data collection, used to detect and prevent fraudulent activity and protect the integrity of our platform.
